These terms govern access to and use of https://codergeist.com. By using the site you accept them. If you do not agree with them, please do not use it.
The Spanish version of these terms is the binding one; this English text is provided for convenience.
In compliance with Article 10 of Spanish Law 34/2002 on information society services and electronic commerce (LSSI-CE), the following details of the site's owner are recorded:
Referred to below as "Codergeist", "we" or "the owner".
The site is Codergeist's corporate presence: it describes the web and software development services we provide and offers a form for getting in touch.
It is not a shop or a platform. Nothing is purchased through the site, no payments are taken, there are no user accounts or private areas, and no visitor-submitted content is published. Any professional engagement is agreed off the site, in a separate contract or quotation governed by its own terms rather than by these.
Access to the site is free and requires no registration. You agree to use it in accordance with the law, these terms and good faith, and in particular not to:
We may suspend access for anyone who breaches these terms, without prejudice to any other remedy available at law.
The form exists so that you can write to us. The data you enter must be accurate, and you are responsible for what you provide; in particular, you should not enter another person's personal data without their consent.
Sending a message creates no contractual relationship and does not oblige us to reply or to accept an engagement. How we process what you send is described in the Privacy policy.
To limit abuse, the form applies a technical control that may reject repeated submissions from the same connection within a period of time.
The site's content — text, design, source code, images, animations and other elements — is owned by Codergeist or used with permission, and is protected by intellectual and industrial property law. The same applies to the name "Codergeist" and its logo.
You may consult the site, and reproduce or print extracts for your own personal use. Any other use — in particular reproduction, distribution, public communication or adaptation for commercial purposes — requires our prior written permission. You can request it at legal@codergeist.com.
Third-party software used on the site remains under the licences of its respective owners.
The site may contain links to third-party pages. They are offered for reference only and do not imply that we endorse their content: we do not control them and are not responsible for what they publish or for their privacy policies, which are yours to review.
You may link to this site provided the link points to its home page or to a complete page, without reproducing it inside another page or presenting it in a way that misleads as to its ownership or suggests a relationship between Codergeist and the linking party that does not exist.
We aim to keep the site available and its content correct and current, but we cannot guarantee that it will run without interruption or error: it depends on third-party services — hosting, network, messaging — and may need maintenance. We may modify, suspend or discontinue the site or any of its content at any time.
The information on the site is general and informational. It is not professional advice and not a binding offer.
To the extent the law allows, we are not liable for damage arising from being unable to reach the site, from errors or omissions in its content, or from failures attributable to third parties or to the user's own equipment or connection. Nothing in these terms excludes or limits our liability where the law does not permit it, including damage caused by wilful misconduct or gross negligence, and the rights that consumer law grants on a mandatory basis.
We may amend these terms when the site or the applicable law changes. The version in force is always the one published on this page, with the "last updated" date shown at the top. We recommend checking it from time to time.
The processing of personal data arising from use of the site is described in the Privacy policy, which forms part of these terms.
If any clause of these terms is held void or unenforceable, it will be treated as not included and the remainder will continue in full force.
These terms are governed by Spanish law.
If you are a consumer, any dispute will be heard by the courts designated by the applicable rules, which as a general matter are those of your place of residence; your rights as a consumer are unaffected by this clause. If you are not acting as a consumer, the parties submit to the courts of Codergeist's registered office, waiving any other jurisdiction that might apply.
